  • Q1 - If a man has infertility problems and refuses to have a treatment for it, what is the ruling for his wife? Is the wife allowed to leave her husband or adopt a child w/o the husband's permission? 

    A - There are a few ways of looking at this: 1. If he knew that he had infertility issues and hid them from you, then it is grounds for divorce. 2. If he did not previously know that he was infertile, then it is not grounds for divorce. 3. If, in addition to infertility, your husband also is sexually dysfunctional where he cannot have intercourse or have intimacy, then the rulings are a bit different. Whether he knew or not before the marriage that he was sexually dysfunctional makes it a grounds for divorce for you. However, if he informed you previously and you accepted the marriage anyways, then there are no grounds for divorce. 4. As for adoption, the consent of both parties is needed regardless of the situations above. 5. Finally, we advise that you and your partner seek Islamic marriage counselling to resolve your outstanding issues which may be available at a center near you.
