Marriage Problems

• Q1 - I wish to get married now , but right now Im not in Pakistan, Im abroad. The person that I want to marry is in Pakistan. Is our Nikkah possible or it is only possible when I go back home to Pakistan. 

  A - Islamically both parties do not have to be physically present for Nikah, but there are many other conditions involved therefore please refer to your Marjeas Islamic laws or the local Aalim.

• Q2 - If a man says to his wife "I divorce you," does that count as a real divorce?

• Q3 - I heard that if a gay man marries a woman without telling he that he's gay, the marriage is void. This is my situation and my wife does not know about this even though I have not acted on my homosexuality. I have been married for five years, is my marriage accepted by Allah? 

  A - Al Hamdulilah that you are out of that situation and I pray for you. Your marriage is okay but I urge you to seek Islamic counseling from a local scholar to help you through these thoughts. You need to have strong commitment not to go towards that path and focus on the bigger picture and your purpose inpleasing Allah.

• Q4 - In Sindh there is an ongoing practice called Haq Bakshish. A friend of mine was forced to do it. The family members get the girl's marriage done to the Quran to prevent her from getting married to anybody. Her sole purpose becomes to recite the Quran. They do this so the family property stays within the family. Is this acceptable as per Islamic law? Does this actually exist? And if a girl still wants to get married despite Haq Bakshish, what should she do? Can she?
